Application of the electronic invoicing obligation between entrepreneurs and professionals.

All entrepreneurs and professionals in their commercial relations with their suppliers and customers are obliged by the Royal Decree. Service providers must issue electronic invoices in their relations with private individuals whenever they so require.

Travel agencies, transport services and retail trade activities (with some exceptions) will be exempt from submitting electronic invoices.

Timeframe for implementation:

One or two years from approval for entrepreneurs/professionals with a turnover of more than 8 million euros. All other entrepreneurs will have a period of 3 years from approval. The regulation will be approved by 29 March 2023 at the latest. The penalty for companies that fail to comply with these regulations will be a fine of up to €10,000.

How it should be implemented.

In the absence of confirmation of a format/design by the tax agency, the ERP must be able to provide an electronic invoice format that will contain the same information as the paper invoice (it will be governed by the specific invoicing regulations) and to read this file in the case of invoices received. It should also be borne in mind that the law includes the possibility for the recipient to request a free copy of the invoice received within a period of 4 years.

The regulation states that: ‘Service providers […] shall provide access to the necessary software so that users can read, copy, download and print electronic invoices free of charge […]’. Therefore, a platform (their own or that of a third party such as SERES) will be enabled for downloading and sending the file containing all the e-invoices.
